Fuel Price Increase: Court Injunction Restrains Labour Union’s Proposed Strike

Unic Press UK: The National Industrial Court, Abuja, which was presided over by President of the National Industrial Court of Nigeria, Justice Babatunde Adeniran Adejumo, today, issued an interim order of injunction restraining the Nigeria Labour Congress (NLC) and the Trade Union Congress (T.U.C) from embarking on strike tomorrow.

In suit No.NICN/ABJ/179/2016, between Federal Government of Nigeria and the Attorney General of the Federation versus Nigeria Labour Congress (NLC) and Trade Union Congress (T.U.C) the court said:

  • An interim order of injunction is hereby granted to restrain the defendants / respondents, their agents from embarking on an industrial action, or engaging in any action that may disrupt the economic activities in Nigeria pending the hearing cum determination of the motion on notice.

The Federal Government legal team comprised of the Attorney General of the Federation and Minister of Justice, Abubakar Malami SAN, and Special Assistant to the President on Prosecution at the office of the Attorney General of the Federation, Okoi Obono-Obla, and Director of Civil Litigation at the Federal Ministry of Justice, Dayo Apata.

The government submitted that:

  • Should the reliefs sought by the appellant be refused, there will be irreparable damage on Nigeria’s national economy, security and corporate existence as the defendants / respondents have threatened to shut down the country.
  • Should the reliefs sought by the appellant be refused, there will be a breakdown of law and order given that defendants / respondents have threatened to shut down the country.

The court granted an interim order of injunction. The case was adjourned to the 23rd May 2016.
