South Africa’s ‘Withdrawal’ From ICC Is Unconstitutional – Court

Unic Press UK: A High Court sitting in Pretoria, South Africa, has ruled that the decision of the South African government to commence the processes for withdrawing from the International Criminal Court (ICC) is unconstitutional and invalid.

Judge Phineas Mojapelo delivering judgement on Wednesday said the executive arm of government should seek the consent/approval of Parliament. He ordered the South African government to terminate the notice of withdrawal that was served on the ICC.

South Africa had signed the Rome Statute on 17 July 1998. The country deposited its instrument of ratification of the Rome Statute on 27 November 2000.

124 countries are the States Parties to the Rome Statute of the International Criminal Court.
