ABUJA, Federal Republic of Nigeria. (Unic Press UK) — A six-man panel of the Supreme Court led by Justice W.S. Nkanu Onnoghen has dismissed an appeal filed by the Senate President, Bukola Saraki, to stop his trial at the Code of Conduct Tribunal (CCT).
Justice Onnoghen and his team said they found no merit in the appeal. They said:
“The 1999 Constitution has not made definite stand on what number constitute a quorum of the tribunal, but the Section 28 of the Interpretation Act did.
“The Interpretation Act holds that a two-member panel that includes the Chairman and one other member constitute a quorum to sit on any matter.
“In the circumstance, the panel was properly constituted when it commenced the trial of the appellant,’’
Given the Supreme Court ruling, Saraki will have to face trial at the CCT where a 13-count charge is still pending following the allegation by the Federal Government that he (Saraki) did make anticipatory declaration on some of the assets he declared while serving as the governor of Kwara State.
