War Crimes In Afghanistan: ICC Appeals Chamber Approves Prosecutor’s Prayer For An Investigation

Unic Press UK: The Appeals Chamber of the International Criminal Court (‘ICC’ or ‘Court’) today unanimously decided that an investigation into alleged crimes in the Islamic Republic of Afghanistan shall proceed, thereby authorising the Prosecutor to commence an investigation.

The ICC Appeals Chamber said it considered the Prosecutor’s grounds of appeal against the Pre-Trial Chamber’s decision, as well as the submissions of the Islamic Republic of Afghanistan, representatives of victims and the other participants, and found that the Pre-Trial Chamber erred; and authorised the Prosecutor to carry out an investigation, within the parameters identified in the Prosecutor’s request of 20 November 2017, including the alleged crimes on the territory of Afghanistan since 1 May 2003, as well as other alleged crimes connected to the armed conflict in Afghanistan.

Today’s Appeals Chamber decision effectively amends the unanimous ruling by the Pre-Trial Chamber II on 12 April 2019 that rejected the Prosecutor’s request to investigate alleged crimes against humanity and war crimes on the territory of the Islamic Republic of Afghanistan.

The United States led an invasion of Afghanistan in 2001, targeting terrorists after the 9/11 terror attacks, and has remained on the territory of Afghanistan to date.
