Appeal Court Halts Order To Arrest INEC Chairman Yakubu Mahmood

Unic Press UK: The Court of Appeal, Abuja, has ordered that a stay of execution of the Federal High Court ruling compelling the Nigerian Police Force to arrest the Chairman of the Independent National Electoral Commission (INEC), Professor Mahmood Yakubu, shall apply pending the hearing/determination of an appeal filed by the INEC chairman.

Judge Abdul Aboki, leading two other justices of the Court of Appeal, said Monday: “We therefore stay the execution of the warrant of arrest pending the determination of the motion on notice, which will be taken together with the main appeal,” the Nigeria Lawyer reports on its website.

A few weeks ago, Judge Stephen Pam of the Federal High Court, Abuja, had issued an order compelling the Nigerian Police Force (NPF) to arrest the Chairman of the Independent National Electoral Commission (INEC), Professor Mahmood Yakubu.

The Federal High Court had concluded that Yakubu deliberately violated several court orders by which he had been summoned to appear before the Federal High Court to answer posers relating to claims by some officials of the Peoples’ Democratic Party (PDP), who alleged that INEC had refused to recognize them in spite of a ruling of the Supreme Court of Nigeria.
